In episode 27 of the Supreme Court Opinions Read podcast, we read the Supreme Court's opinion in Hain Celestial Group v Palmquist. In this case, a suit brought in Texas state court against citizens of Texas and other states was removed to federal court. The distrcit court dismissed the Texas defendant, asserted diversity jursidiction over the suit, and rendered judgement in favor of the remaining defendant. The dismissal was found to be erroneous by the Fifth Circuit. The question before the Court then: did the lack of diversity jurisdiction at time of removal require vacature of the district court's judgement, or did the district court's erroneous dismissal cure that jurisdictional defect, allowing the judgement to stand?
