  • Episode 8 Attorney Wright saw an interesting question posted on an online legal forum recently: Will I look bad if I refuse mediation? Reasons not to go may be many, but there could be consequences in court if your refuse. What does that mean for your case? What will the judge think? Are you putting your case at risk? Do you run the risk of giving the family law judge the wrong impression if you refuse to try to settle your case through the conciliation process?Although the conciliator/mediator is impartial, has family court experience and is trustworthy, you still may not be able to see yourself sitting down with your ex at the same table. Maybe you suffered abuse and trauma and you don’t feel safe, or maybe you still just have unresolved anger issues and it’s just too much to deal with. In this episode, Ellen Wright is joined by Attorney David Eppley of the Wright Family Law Group to discussion mediaiton in Massachusetts.DAVID EPPLEY focuses his practice in all areas of family law including litigation, mediation, conciliation, and arbitration, including the niche area of LGBT family issues. • It’s no secret that divorce and bankruptcy are among the most stressful and emotionally devastating experiences anyone can go through. In fact, it’s safe to say that bankruptcy and divorce are the two areas of law people hope to avoid in their lifetime. Because married people often share the same financial issues and challenges, bankruptcy and divorce often go hand-in-hand. Most people understand the general concepts of bankruptcy and divorce, but the interplay between the two is usually a mystery. The intersection of these two areas of law can be very complex and be a source of great confusion. As such, people often have many questions about it. However, in many instances people are too overwhelmed to even think about it, let alone discuss it. In this episode Alethea Shaddox and Ellen Wright discuss the overlap and interplay between people who are facing divorce and bankruptcy. The Massachusetts Department of Children and Families (MA DCF), will begin the DCF investigation process when they believe a child is being abused or neglected. This means DCF has reason to suspect that a caregiver has intentionally harmed a child physically, emotionally, or sexually. The 51B Investigation happens after a 51A report is filed. DCF will investigate cases where the report describes a child who is not receiving adequate care. DCF will compile their findings into what is called a “51B report”. In other cases, DCF will do an emergency taking of the children in severe cases of abuse and neglect and the parents will be given an opportunity to state their case as what is called a 72 hour hearing.

Although most parents love their children, there are many that do not have the support they need to parent effectively. Some parents may be alone and without anyone to turn to when they are exhausted or don’t know how to handle situations they are confronted with. Sometimes parents work hard to feed and house their children and experience stresses that make taking care of their children a challenge – and every parent sometimes needs the help of other caring adults.

As a supplement to this episode, Ellen discusses the fundamentals of how to survive a Massachusetts DCF investigation and goes over the major pitfalls that every caregiver that has DCF involvement should know about when being investigated.
